By accepting these terms and conditions, this institution agrees that .decimal® support may install and/or provide access to proprietary software. It is understood that you may not copy, distribute, publish, recast, translate, or modify this software, or any copy, adaptation, transcription, or derivations. You may not sell, donate, transfer, assign, lease, license, or sublicense this Software. Failure of the above will constitute a breach of this agreement, revocation of the software licenses and/or privileges, as well as initiation of legal action.

Additionally, .decimal® custom devices are designed by your staff and the specifications of these devices are based upon your beam data, beam models, and planning techniques. Therefore, by agreeing to these terms and conditions, this institution further agrees to:

ASSUME FULL RESPONSIBILITY FOR (A) VERIFYING THE MANUFACTURE OF EACH PRODUCT TO THE SPECIFICATIONS SUBMITTED TO .DECIMAL, LLC., FOR THE MANUFACTURE OF THAT PRODUCT AND (B) FOR THE TESTING OF EACH PRODUCT PRIOR TO USE ON A HUMAN PATIENT. ONLY AFTER TESTING AND YOUR APPROVAL THEREOF, SHALL .DECIMAL, LLC.’S PRODUCT OR PRODUCTS BE USED IN YOUR PATIENT’S TREATMENT.

IN NO EVENT SHALL .DECIMAL, LLC., BE HELD LIABLE TO ANY CUSTOMER, PATIENT, EMPLOYEE OR PERSON UNDER ANY THEORY OF LIABILITY FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND OR NATURE WHATSOEVER, ARISING FROM THE USE OF .DECIMAL, LLC.’S PRODUCT. DIRECT DAMAGES SHALL BE LIMITED TO THE COST OF THE ALLEGED DEFECTIVE PRODUCT OR PRODUCTS.
